These Terms of Use ("Terms") govern your use of cdalandscape.com and spokanelandscape.com (the "Sites"), operated by Cross Creek Landscape Design + Build ("Cross Creek," "we," "us," or "our"). By using the Sites, you agree to these Terms. If you don't agree, please don't use the Sites.
Our Sites Are for Information Only
The Sites share information about our landscape design and construction services, examples of our work, and ways to contact us. Nothing on the Sites is a quote, bid, offer, or guarantee.
- Any prices, investment ranges, timelines, or project descriptions on the Sites are general examples. Your actual price and schedule depend on your property, design, materials, site conditions, permits, and season.
- Photos, renderings, and project galleries show past or sample work. Plant, stone, and material availability, color, and appearance vary.
- Articles, tips, and plant information are general guidance, not professional advice for your specific property. Always confirm local codes, HOA rules, and utility locations before starting work.
Your Project Agreement Controls
Design and construction work is governed only by a written agreement signed by you and Cross Creek. These Terms cover your use of the Sites. If anything in these Terms conflicts with your signed project agreement, your project agreement controls. Any warranties on our work are stated in your project agreement, not on the Sites.

Using the Sites
You may use the Sites for your personal, non-commercial use, such as learning about our services, viewing our work, and contacting us. You agree not to:
- Use the Sites in any way that breaks the law or violates anyone else's rights
- Submit false information, impersonate someone else, or send spam or unsolicited advertising through our forms
- Try to gain unauthorized access to the Sites, our systems, or other users' information, or interfere with how the Sites work
- Upload viruses or other harmful code
- Use bots, scrapers, or other automated tools to copy or collect content or data from the Sites
- Use any content from the Sites to train, develop, or improve artificial intelligence or machine learning systems without our written permission
Our Content and Designs
The Sites and everything on them, including photos, videos, landscape designs, renderings, plans, plant guides, text, graphics, logos, and the Cross Creek name, belong to Cross Creek or to the people and companies who license them to us. They are protected by copyright, trademark, and other laws.
You may view and share links to our pages, and you may print or save pages for your own personal reference. You may not copy, reproduce, modify, sell, or publish our content, and you may not use our designs, renderings, or plans to build a project, without our written permission.
Information and Files You Send Us
When you send us information, photos, plans, or other files through the Sites, you confirm that you have the right to share them, and you give us permission to use them to respond to you and to evaluate, design, and build your project. Please do not send sensitive information such as Social Security numbers or bank or card numbers through our website forms.
Our Privacy Policy explains how we handle the information you share, including text messages and marketing emails.
Contacting You
When you submit a form on the Sites, you agree that we may contact you by phone or email about your inquiry. We will send you text messages only if you have agreed to receive them. You can stop texts at any time by replying STOP. See the Text Messages section of our Privacy Policy for details.
Reviews and Testimonials
Client reviews and testimonials on the Sites reflect the individual experiences of those clients. Every property and project is different, and your results may vary.
Other Websites
The Sites may link to or show content from other websites and services, such as Instagram, Facebook, Houzz, Google, and our suppliers. We don't control those sites and aren't responsible for their content, products, or privacy practices. Your use of them is governed by their own terms.
Privacy and Cookies
Your use of the Sites is also governed by our Privacy Policy and Cookie Policy.
Disclaimers
The Sites and their content are provided "as is" and "as available." To the fullest extent permitted by law, Cross Creek makes no warranties of any kind about the Sites, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We work to keep the Sites accurate and available, but we don't guarantee that they will be error-free, secure, or uninterrupted.
This section applies to the Sites only. It does not change any warranty in a signed project agreement.
Limitation of Liability
To the fullest extent permitted by law, Cross Creek will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost data or profits, arising from your use of, or inability to use, the Sites. Our total liability for any claim related to the Sites will not exceed one hundred U.S. dollars ($100).
This section applies to your use of the Sites only. It does not limit our obligations under a signed project agreement, and it does not apply where the law doesn't allow these limits.
Indemnification
You agree to defend, indemnify, and hold harmless Cross Creek and its owners, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Sites or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute about these Terms or the Sites will be brought in the state or federal courts located in Kootenai County, Idaho, and you agree to the jurisdiction of those courts. Disputes about a project are governed by your signed project agreement.
Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Your continued use of the Sites after an update means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest will stay in effect. If we don't enforce a part of these Terms, that doesn't waive our right to enforce it later. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Cross Creek about your use of the Sites.
